Terms of Use (EULA)

1. Agreement
These Terms of Use (“Terms”) are a binding agreement between you and Jose Emanuel Cascone Rego de Sousa, 29 Flat 1, Triq V. Menville, Is-Swieqi SWQ 2161, Malta (“iQuit,” “we,” “us”). By creating an account or using the iQuit mobile application, web application, or website (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
iQuit is a smoking-cessation support tool: it tracks your quit progress, cravings, savings and health-recovery milestones, offers journaling, breathing exercises, an AI coach, and an optional community.
3. Not Medical Advice
The Service provides motivational and informational support only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified health professional about nicotine withdrawal, medication, or any health condition. Never disregard professional medical advice because of something you read in the Service.
4. Accounts
You must provide accurate information when registering and keep your credentials secure. You are responsible for activity under your account. You may delete your account at any time in the app (Profile → Delete Account); deletion is permanent and removes your personal data as described in the Privacy Policy.
5. Subscriptions and Purchases
iQuit offers optional premium access:
- iQuit Premium Monthly — auto-renewable subscription, 1 month
- iQuit Premium Yearly — auto-renewable subscription, 1 year
- iQuit Lifetime — one-time purchase
Prices are shown in the app in your local currency before purchase. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends, at the price shown when you subscribed. You can manage or cancel subscriptions anytime in your device’s account settings (App Store: Settings → Apple ID → Subscriptions; Google Play: Menu → Subscriptions). If offered, any free-trial period converts to a paid subscription unless cancelled at least 24 hours before the trial ends; unused trial time is forfeited on purchase. Refunds are handled by Apple or Google under their store policies. Statutory consumer rights, including EU withdrawal rights, remain unaffected.
6. Acceptable Use
You agree not to misuse the Service, including: posting unlawful, harassing, or harmful content in the community; promoting tobacco or nicotine products; attempting to breach security; reverse-engineering the app except where permitted by law; or using the Service for anyone under 16. We may remove content or suspend accounts that violate these Terms.
7. User Content
You retain ownership of the content you create (journal entries, posts, messages). You grant us a limited license to store and display it as needed to operate the Service, and, for community posts, to show them to other users as you direct. You are responsible for what you post.
8. Intellectual Property
The Service, including its software, design, and content (excluding your content), is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, in accordance with these Terms and the applicable app-store rules.
9. Disclaimer and Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination (including 7–9 and 11) survive.
11. Governing Law
These Terms are governed by the laws of Malta, without prejudice to mandatory consumer protections of your country of residence. Disputes are subject to the jurisdiction of the courts of Malta, unless mandatory law provides otherwise.
12. Changes
We may update these Terms from time to time. Material changes will be announced in the app or by email; continued use after changes take effect constitutes acceptance.
