The legal smoking age by country is not one number. In the United States you must be 21 to buy any tobacco or vape product. In the UK, Canada, Germany and Australian states such as New South Wales the baseline is 18, while Singapore sets 21 and some Canadian provinces set 19 or 21. The biggest change is in the UK, where anyone born on or after 1 January 2009 will never be able to buy tobacco legally once the new law takes effect in 2027.
This guide explains what these laws actually cover, how Tobacco 21 works in every US state, what the UK’s Tobacco and Vapes Act 2026 changes and when, how Canada, Australia and other countries compare, whether vapes and nicotine pouches follow the same rules, and what to do if you started smoking before you were legally old enough.
What is the legal smoking age?
When people say “legal smoking age,” they usually mean the minimum age of sale: the age below which a shop or website may not sell you tobacco. The laws covered in this guide are written as offenses for the seller. For example, the US federal law makes it illegal for a retailer to sell tobacco to anyone under 21, and the new UK law makes it an offence to sell tobacco to anyone in the protected age group.
That distinction matters in three ways:
- Sellers carry the main legal risk. Retailers can face fines or lose their license for selling to underage customers.
- Buying on someone’s behalf can also be an offence. The UK Act, for example, makes it an offence for an adult to buy vapes or nicotine products for someone under 18.
- Rules on possession and use vary. Some places also restrict possession or smoking in certain places, so check local laws where you live.
Age-of-sale laws exist because most smoking starts young and nicotine dependence can build quickly. The FDA notes that young people have a higher risk of becoming addicted than adults because their brains are still developing. For the latest youth use data, see our teen smoking statistics.
United States: Tobacco 21 explained
On December 20, 2019, the President signed legislation raising the federal minimum age of sale for tobacco products from 18 to 21. According to the FDA’s Tobacco 21 page, the law, known as Tobacco 21 or T21, took effect immediately.
| Question | Answer |
|---|---|
| Minimum age of sale | 21, for all retail establishments and persons, with no exceptions |
| Products covered | Cigarettes, smokeless tobacco, hookah tobacco, cigars, pipe tobacco, liquid nicotine, e-cigarettes and e-liquids |
| Non-tobacco nicotine | Covered: retailers may not sell products with nicotine from any source to under-21s |
| Military exemption | None for active duty personnel or veterans aged 18 to 20 |
| ID checks | Since September 30, 2024, photo ID required for anyone under 30 |
| Vending machines | Not allowed where people under 21 are present or permitted to enter |
Does the smoking age differ by US state?
Not for sales. The federal minimum of 21 applies in every state and territory, so no store anywhere in the US may legally sell tobacco or vapes to someone under 21. States and cities can still pass their own tobacco laws, for example on licensing, penalties, flavors or where you can smoke, so the details around the age limit vary. If you see an older state law that still says 18, the federal rule still binds retailers.
Federal tobacco policy keeps moving beyond age limits too. See the menthol ban data and the FDA nicotine cap, which the FDA proposed in January 2025 to make cigarettes minimally or non-addictive.

UK and the generational ban
Today the UK age of sale for tobacco is 18. That is about to change. The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. It makes it an offence to sell tobacco products, herbal smoking products or cigarette papers to anyone born on or after 1 January 2009.
| Rule | Where | When |
|---|---|---|
| No tobacco sales to anyone born on or after 1 January 2009 | England and Wales, Scotland, Northern Ireland | From 1 January 2027 |
| No sales of vaping or nicotine products to under-18s | England and Wales | Under Part 1, which comes into force six months after Royal Assent unless stated otherwise |
| No buying vapes or nicotine products for under-18s | England and Wales | Same as above |
In practice, people who turn 18 on or after 1 January 2027 will never reach the legal age to buy cigarettes in the UK, and the protected group grows by one year every year. The Act also repeals the old under-18 tobacco sales offence it replaces. Our full explainer on the UK generational ban covers the debate, enforcement and what it means for current smokers.
The Department of Health and Social Care set out the original smokefree generation plan in this 2024 video, before the policy became law in 2026:
Canada and Australia
Canada: 18 federally, higher in some provinces
Health Canada states that it is illegal to sell or provide tobacco products to anyone under 18, and that some provincial laws have increased this age to 19 or 21. The same federal age of 18 applies to vaping products, again with some provinces setting a higher age. Because the provincial age can be higher than the federal one, check the rules in the province where you are buying.
Australia: set by states and territories
In Australia, tobacco retail laws are made by the states and territories. In New South Wales, for example, NSW Health says the law bans the sale of tobacco products and non-tobacco smoking products to anyone under 18. NSW Health covers vaping and nicotine products under separate laws, so check those rules on their own.
New Zealand: a generational ban that was repealed
New Zealand passed a smokefree generation law, but in February 2024 the government repealed the measures that would have banned sales to people born after 2008, mandated very low nicotine cigarettes and cut the number of tobacco retailers, according to a 2025 study in the New Zealand Medical Journal. The UK’s version, by contrast, is on the statute book with a start date.
Other countries: a quick table
The table below includes only countries where we checked a government or legislation source in September 2026. Ages refer to the minimum age of sale for tobacco.
| Country | Minimum age | Notes | Source |
|---|---|---|---|
| United States | 21 | Federal law since December 2019; includes vapes and non-tobacco nicotine | FDA |
| United Kingdom | 18 now | From 1 January 2027, no sales to anyone born on or after 1 January 2009 | Tobacco and Vapes Act 2026 |
| Canada | 18 federally | Some provinces set 19 or 21 | Health Canada |
| Australia (New South Wales) | 18 | States and territories set their own retail laws | NSW Health |
| Germany | 18 | Youth Protection Act bans supplying tobacco and nicotine products to under-18s | Jugendschutzgesetz |
| Singapore | 21 | Raised one year at a time: 19 in 2019, 20 in 2020, 21 in 2021 | Health Sciences Authority |
| New Zealand | Not listed | Smokefree generation law repealed in February 2024 | NZ Medical Journal |
Two patterns stand out. First, several governments have moved from 18 to 21, either in one step like the US or gradually like Singapore, where the Health Sciences Authority lists each yearly increase. Second, the UK has chosen a different model: a birth-date cut-off that rises every year. Age limits also sit alongside very different smoking rates, which you can compare in our ranking of smoking rates by country.
If you are traveling or living abroad, the local rule applies, not the rule from your home country. A 19-year-old from Canada, for example, cannot legally buy tobacco in the US or Singapore.
Do vapes and pouches have the same age limit?
Often, but not always. Here is how the countries with verified rules handle other nicotine products:
- United States: yes. Tobacco 21 covers e-cigarettes, e-liquids and liquid nicotine, and the FDA says retailers may not sell nicotine from any source, including non-tobacco nicotine, to anyone under 21.
- United Kingdom: not the same rule. The generational ban applies to tobacco, herbal smoking products and cigarette papers. In England and Wales, vapes and nicotine products such as pouches have a separate age limit of 18 under the 2026 Act.
- Canada: the federal age for vaping products is 18, with some provinces setting 19 or 21, matching the tobacco rules.
- Germany: the Youth Protection Act covers tobacco products and other nicotine-containing products for under-18s.

If you started before the legal age
Age-of-sale laws are aimed at retailers, not at punishing young people who already smoke or vape. If you started early, the most important thing is getting support to stop, not worrying about the law. Here is what to know:
- Talk to a doctor, nurse or pharmacist. Treatment options differ for young people. In the US, the FDA notes there are no FDA-approved nicotine replacement products for youth use and advises talking to a health care provider. In England, NICE says cytisinicline, varenicline and bupropion should not be offered to people under 18.
- Use free support services. In the UK, NHS stop smoking services are free and you can contact them directly. Our guide to NHS stop smoking services explains how to self-refer.
- Know that quitting early pays off. The sooner you stop, the less time nicotine dependence has to take hold and the more your body can recover.
- Plan for triggers. Friends who smoke, stress and exam periods are common triggers. Writing down when cravings hit helps you plan around them.
A free app can help with that last step. iQuit is rated Everyone on Google Play and lets you log each craving with its trigger and intensity, get SOS support when an urge hits, and watch your days smoke-free and money saved add up. It works alongside professional support rather than replacing it.
Smoking Age FAQ
What is the legal smoking age in the US?
It is 21 nationwide. Since December 20, 2019, federal law has made it illegal for any retailer to sell tobacco products, including e-cigarettes, to anyone under 21, with no exceptions for military personnel. Since September 30, 2024, retailers must check photo ID for anyone under 30 (FDA).
Is the smoking age 18 or 21 in my state?
The federal minimum age of 21 applies to all retail sales in every US state, so no store may legally sell you tobacco or vapes before 21. States and cities may add their own rules on licensing, penalties or flavors, but the federal age still applies to every retailer (FDA).
What is the legal smoking age in the UK?
It is currently 18. Under the Tobacco and Vapes Act 2026, from 1 January 2027 it becomes an offence to sell tobacco to anyone born on or after 1 January 2009, across England, Wales, Scotland and Northern Ireland. In England and Wales, the Act sets an age limit of 18 for vapes and nicotine products (Tobacco and Vapes Act 2026).
Which countries have a smoking age of 21?
Among the countries we verified, the United States and Singapore set 21. Singapore raised its minimum legal age one year at a time, reaching 21 on 1 January 2021. Some Canadian provinces also set 21, above Canada’s federal age of 18 (FDA, Health Sciences Authority, Health Canada).
What is the legal smoking age in Canada?
Federal law makes it illegal to sell or provide tobacco or vaping products to anyone under 18. Some provinces have raised the age to 19 or 21, so the age that applies depends on the province where you buy. Check your provincial rules before assuming 18 applies (Health Canada).
Did New Zealand ban smoking for young people?
New Zealand passed a smokefree generation law, but in February 2024 the government repealed it, along with plans for very low nicotine cigarettes and fewer tobacco retailers. The UK’s Tobacco and Vapes Act 2026, by contrast, is law and takes effect for tobacco sales on 1 January 2027 (New Zealand Medical Journal, 2025; Tobacco and Vapes Act 2026).
Can I get in trouble for smoking under the legal age?
The US and UK age laws covered here are written mainly as offenses for sellers, and in the UK also for adults who buy vapes for under-18s. Local rules on possession or smoking in certain places can differ, so check where you live, and focus on getting support to quit (FDA, Tobacco and Vapes Act 2026).
Can teenagers use nicotine patches to quit?
In the US there are no FDA-approved nicotine replacement products for youth use, so the FDA advises talking to a health care provider about options. In England, NICE says stop smoking tablets such as varenicline should not be offered to under-18s. A doctor or stop smoking service can advise on safe support (FDA, NICE).
